France's highest administrative court refers Google right to be de-indexed case to CJEU

On July 19, 2017, France’s highest administrative court, the Conseil d’Etat, referred the dispute between the French data protection authority (CNIL) and Google over the legality of applying the right to be de-indexed globally to the Court of Justice of the European Union (CJEU). Google had appealed an order from the CNIL to delist results globally in May 2016, after the data protection authority had fined the platform 100.000 euros for not doing so. In its statement, the Conseil d’Etat said that it had asked the CJEU how the right to be de-indexed should be applied, and most importantly whether it can apply outside of the borders of the European Union.
