Austria’s Supreme Court refers case over Facebook’s responsibility to remove hate speech to CJEU

On January 11, 2018, the Supreme Court of Austria referred a case over Facebook’s responsibility to remove hate speech from its platform to the Court of Justice of the European Union. In May 2017, an appeals court had ruled that Facebook had to globally remove hate speech posts against the plaintiff, former Austrian Green Party leader Eva Glawischnig, as well as similar postings.
