I&J Referenced in UNCTED Trends Report on Lawful Access to Digital Evidence

On February 16, 2022, Bertrand de La Chapelle, Executive Director of the Internet & Jurisdiction Policy Network spoke at the United Nations Counter-Terrorism Committee Executive Directorate (CTED) event to launch a Trends Report on The State of International Cooperation for Lawful Access to Digital Evidence.

The meeting brought together actors from governments, the private sector, civil society, and academia to discuss the findings and share views on the current state of legislative developments, and the work that the different actors are doing on the topic. 

Prepared in accordance with Security Council resolution 2617 (2021), the report references the work of the Internet & Jurisdiction Policy Network Data & Jurisdiction Program which seeks to address cross-border access to electronic evidence through the development of operational solutions to policy challenges and mechanisms to enable interactions between governments and the private sector.

The CTED report provides a snapshot of the regulatory reform landscape as of late 2021 and presents some of the major trends that contribute to the current overall cross-border situation in the area of lawful access to digital evidence.

The Data & Jurisdiction Program Contact Group is following several major reform initiatives mentioned in the report that surround law enforcement authorities' access to electronic evidence data including regional initiatives such as that of the European Union e-evidence proposals as well as multilateral initiatives such as the draft United Nations Convention on Countering the Use of Information and Communications Technologies for Criminal Purposes and the recently adopted Second Additional Protocol to the Council of Europe Convention on Cybercrime (Budapest Convention) on enhanced co-operation and the disclosure of electronic evidence.

Toolkit to inform public, private, and civil society actors on the components of, and the requisite due process standards and guarantees for the development of cross-border access to electronic evidence regimes. The Contact Group continues to develop common resources that can provide actors with clarity on their respective roles and responsibilities in the process of cross-border access to electronic evidence.
